    Small claims court

    Hi all,

    I was wondering if anyone here has any experience of using the small claims court? I've got a probelem with the supply of some parts for my stag to the tune of over £2k and it's becoming increasingly evident that I may have to resort to this in order to get the money back. I don't want to say who the supplier is but suffice to say that it isn't one of the regular ones or repair shops (to allay any alarm you may have).

    My restoration so far is a slow journey although things are progressing, but I could certainly do without this! So basically I need to know is it expensive, what evidence is needed etc. A PM would be great if you could spare the time and have any info.

    not done it my self, but i think its quite easy, there a small fee £25 comes to mind and theres a limit not sure of limit,good luck

        As long as you have the written evidence getting judgement in your favour is relatively straightforward but you're only at the starting gate. The real problem is getting paid. Your seller may already have a string of CCJs so one more won't hurt him. May be worth ringing the local court where your supplier is and try and speak to a bailiff. They all have their regulars and if you get a hearty laugh then you can probably say goodbye. Yes the law is an ass.

          James the process is pretty straight forward and can even be done on line which I have used successfully on a couple of occasions:

            i have used small claims court to some satisfaction. i think as you are dealing with a supplier you may get a positive result, once blame or fault is established; it is a slow process.
            in my own case i have found the system is not as it should be, i took a client to court for non payment, he did not contest and i won the case, but getting the money is the tricky bit. he continually misses payments and there does not appear to be any way of enforcing , without getting heavy !

              Hi James
              We had to do this years ago, and as other have said it was inexpensive and straight forwards. Although we did not initially recover any money, about a year later we got a cheque for the full amount because apparently the guy involved wanted to clear his name. Hopefully he learnt his lesson.
