No battery clamp but MOT pass?

I note that my new car has no battery clamp. I actually bought one and attempted to fit it while I was replacing the power steering and alternator drive belts, but it appears the battery is slightly smaller than standard and I could not get the standard clamp & 'J' bolts to fit, HOWEVER I presume the battery was 'clampless' when it passed its MOT. Was this an oversight by the MOT tester?

Mine has not had a clamp since I've owned it as the battery has always been too big for the standard clamp which I bought.Really,to be safe and stop the battery lead fowling the fan pulley it should be clamped but mine has always passed it's MOT and using different test centres !

the only mot requirement is that the battery is not liable to tip over or foul moving parts,if it can that is now a reason for rejection
