    traders insurance

    I have just about had the worst weekend of my life. After reading several legal pages should any trader working on a your car on your property carry insurance. Being self emplyed I carry 5 million public and employers liabilty.
    Also I'm reading that any trader has a duty of care towards my car and should be prepared to pays reasonable costs for the repair. I had offered 50 /50 through my usuall hating conflict (for those who know I'm a nice guy )
    This was more or lesss rejected and its turned sour .
    Any help or expieriences would be nice, also please could any member check who is working on your car and do they have insurance . This set back wont be the end of edds stag project but i think a nearly 2k bill for the damage could be on the cards plus I need to finish the work he had started. I'd rather not name names at present or what the trader was doing but lets just say I litterally cried when I returned to see my car. As with most of the jobs I do, I wish I had done it myself. I also have a neighbour as a witness who also noticed him hitting the living daylights of of my car a sign he is a complete idiot.

    Edd, I can't help but I'm both gutted for you and morbidly intrigued to know what happened and who did it.

        I won't be naming any names at present here but it's not a forum trader .The post is more about insurance and liability and the duty of care we entrust to others whilst they are working on our pride and joys .

          Edd, sorry to hear you are having problems after all the love you have lavished on this rebuild.

          From my layman's understanding any trader has to display reasonable competence and care as a minimum and, of course, most are insured, but PL isn't enough, he will need product liability for you to be able to make a claim.

          As part of our PL insurance at work we have DAS legal assistance cover - do you have that as part of any of your household or trader policies. They will be very helpful; ditto FSB lawyers or even CAB

              What? Like the rest, I'm intrigued to know what happened. Really sad that someone has damaged your Stag.

                Hi Edd,

                Really sorry to hear it has turned sour - after our chat I was optimistic that things would get sorted out ok.

                Sadly, life just ain't fair and I'm sorry to say that if you go down the legal route then it'll cost you loads with no guarantee of getting anything out of it. With this in mind I'd be still trying to see what you can get, even if it still costs you money eg reduced price parts etc.

                Give me a call if you think I can do anything to help but I wish you all the very best.

                    Cheers guys at least I can rely on some support from the forum .
                    Starting the process of repair tomorrow front wing needs pulling out and door needs work too . The trader reversed the car into a concrete wall with the door open . Some worrying stories from neighbours who witnessed his work . With him not insured I'm using my ballance I owed him as payment which considering the damage and heartbreak caused is very fair .

                        Cheers Glenn. We might have to put that beer off a while longer but we will get there . I'm closing this thread now as I need to just concentrate on the positive my wife kids and dogs are all okay and healthy and the car will be fixed .
