My point is Richard, that some individual (maybe not the sharpest tool in the box) would see the BIN price and just hit the button without reading the full description.
The "you will receive a photo" is the last thing you read in the listing. Now be honest is that how you would make a listing on ebay, I have sold a few things on there but wouldn't take that approach
We obviously see it differently. Not a bad thing, but I like to think I'm not out to take advantage of people.

Not willing to test it but I would have thought that as far as ebay is concerned, the BIN price would be binding.
Just asked the question "Surely it is the the Buy it Now price that is binding. It would be duplicitous otherwise. BTW I will post your answer in the Stag Owners Club Forum"
I have tested this in the past to my advantage; many years back I bought a rover 45 off a woman advertising it on eBay, she had put a reserve price on which it was never going to make, then when it didn't sell put it back on with a BIN price that was about £300 less than her original reserve price. I hit the BIN and phoned her up to arrange payment, she promptly said she wasn't prepared to sell it at the price I'd bought it for to which I said but I've bought it, that's the deal. She tried to have it reversed by eBay but they wouldn't do it.
I collected the car two days later and paid the BIN price in cash.
Looking at his other adverts, I'm surprised ebay let him on at all. He's selling a building plot in Slough for £9.99 in addition to several cars at 99p

Slightly off topic but I bought a jacket on ebay from America that I paid the BIN price last week, two days later I get a email off of the seller telling me he's giving me my money back(which he has now) because the person who's jacket it was decided he didn't want to sell it now, I reported him but I'm not sure what the rules are regarding this sort of thing? I'm guessing he's been offered more for it.
honestly chaps do not search "breaking" on ebay. you might see how widespread this practice is. I strongly suspect that ebay is not onto this because they would lose so much business.
More scrupulous "breaker" advertisers will list the bit you need in a private auction to BIN and that is inside ebay rules.
to each their own I guess oh and caveat emptor
